Web Design Service Terms
These terms apply only to website design and related digital services. They do not govern NextWave internet, phone, SIM, equipment, or connectivity services.
Effective September 2, 2026. Before paying, please confirm the plan, total, project details, delivery estimate, revision allowance, and any add-ons shown in checkout. This is a customized digital service; no physical product is shipped.
1. Scope of website services
Your selected plan, approved project details, add-ons, and paid order define the project scope. Every plan includes essential on-page SEO setup and one available standard-priced .com registration for the first year. Starter includes three pages, contact actions, and five revision rounds. A custom logo is included with Starter only when the checkout expressly identifies an active logo promotion or when separately purchased; otherwise we professionally place a customer-provided logo. Business includes five pages, custom logo design, enhanced on-page SEO, map, service, gallery, contact, and ten revision rounds. Growth includes up to eight pages, custom logo and coordinated visual direction, enhanced on-page and local SEO structure, lead capture, booking or payment-link setup, analytics, social sharing, favicon, priority-update features, and unlimited reasonable revisions within the approved scope. Ecommerce builds, memberships, custom applications, advanced integrations, professional photography, accessibility certification, ongoing SEO campaigns, and large content migrations are outside scope unless included in writing.
Expedited Build add-on: For an additional $50, the project receives priority placement ahead of standard website orders in the production queue. Timing begins only after all required information, content, approvals, and access are received. Expedited placement is not a guaranteed same-day service or a guaranteed delivery date; any specific deadline must be confirmed in writing.
2. Client materials and responsibilities
You will provide complete, accurate business information, branding, text, images, account access, approvals, and feedback reasonably needed to complete the project. You represent that you own or have permission to use all materials you provide. You are responsible for the accuracy and legality of your business claims, offers, policies, and regulated content.
3. Design and revisions
Starter includes five reasonable revision rounds; Business includes ten reasonable revision rounds; and Growth includes unlimited reasonable revision rounds while the project remains within the originally approved scope. A revision adjusts the approved design or content within that scope; it does not include a new design direction, additional pages, new functionality, or a replacement project. Additional work outside the plan allowance or approved scope is billed at the posted add-on rate or separately quoted unless otherwise agreed in writing.
4. Schedule and client delays
Any timeline is an estimate that begins after payment and receipt of all required business information, logo or logo instructions, photos, service details, contact information, requested content, and access. The regular Starter target is 24–48 hours. If checkout expressly shows a promotional under-24-hour target, that target applies instead. Neither target is a guaranteed deadline. Delays in content, feedback, approvals, account access, or third-party services extend the schedule. Projects inactive for 30 days may be paused and require rescheduling.
5. Domain registration
The included domain is limited to one available standard-priced .com registration for the first year. Premium domains, aftermarket purchases, transfers, privacy add-ons, special extensions, and renewal fees are not included unless stated in writing. Domain availability cannot be guaranteed until registration succeeds. Ownership and administrative access will be documented during onboarding, and the client remains responsible for accurate registrant information and future renewal costs.
6. Launch and acceptance
You will review the final website before launch. Written approval, publication, or use of the website constitutes acceptance, subject to correction of any documented item that materially differs from the agreed scope.
7. Third-party services
Domains, hosting, forms, analytics, fonts, plugins, payment services, and other tools may be provided by third parties. Their availability, policies, pricing, and performance are outside our control. Third-party fees are your responsibility unless expressly included.
8. Ownership
NextWave Web Studio is a digital-service business line owned and operated by NextWave Mobility. After full payment, you own the final client-specific text and visual design created for your project, excluding pre-existing tools, licensed assets, reusable components, platform code, third-party materials, hosting infrastructure, credentials, and our general know-how. You retain ownership of materials you provide. Third-party assets remain subject to their licenses. Hosting, deployment, maintenance, backups, forms, monitoring, and billing controls remain operated under the separate Website Hosting & Maintenance Agreement.
9. No performance guarantee
We do not guarantee search rankings, traffic, leads, sales, uptime, legal compliance, accessibility certification, or business results. SEO visibility setup means sound on-page structure, metadata, headings, image text, and related launch configuration—not guaranteed rankings or an ongoing search-marketing campaign.
10. Liability
To the fullest extent permitted by law, our total liability arising from the design project will not exceed the amount you paid for that project. We are not liable for indirect, incidental, special, lost-profit, lost-data, or third-party losses.
11. Digital-service and payment-dispute acknowledgment
Website design is a customized digital service. No internet service, phone plan, SIM card, equipment, shipping, or physical product is included unless expressly stated in a separate written order. Contact us first about a billing concern so we can investigate. We may preserve and submit order details, checkout consent, project communications, work records, delivery records, access logs, cancellation records, and other relevant evidence when responding to a payment dispute or chargeback. A chargeback does not automatically cancel an undisputed obligation or grant rights to unpaid work, but nothing here restricts a good-faith dispute or any right that cannot legally be waived.
